General Terms and Conditions Yvonta

These general terms and conditions apply to all agreements relating to subscriptions, products and/or services offered by Yvonta, located at Krijtmolen 53, 8044TK Zwolle, registered with the Chamber of Commerce under number 94851611.
Definitions
1.1 Subscription: An agreement between Yvonta and the customer for the periodic delivery of magazines. 1.2 Direct debit: The customer's continuous authorization to Yvonta to automatically debit the subscription costs from the account specified by the customer. 1.3 Customer: The natural person or legal entity who takes out a subscription or uses our services. 1.4 Magazines: The periodic publications that are delivered twice a year by Yvonta. 1.5 Agreement: Any agreement or arrangement between Yvonta and the customer regarding the delivery of services, products or subscriptions.
Applicability
2.1 These general terms and conditions apply to all offers, agreements and deliveries from Yvonta. 2.2 Deviations from these general terms and conditions are only valid if agreed in writing. 2.3 If a provision in these conditions proves to be null and void, the other provisions will remain in full force.
Subscriptions
3.1 Duration and termination
Subscriptions are initially concluded for a period of 1 year.
- At the end of the initial term of one year, the subscription is automatically extended by one month. After the initial term of one year, subscriptions can be cancelled by the customer at any time with a notice period of one month.
- Customers will receive a reminder of the upcoming automatic renewal and their right to cancel at least one month before the end of the initial subscription period. This reminder clearly describes the cancellation procedure and any applicable deadlines. * If a customer chooses to cancel, the cancellation will take effect at the end of the current subscription month in which the cancellation period expires.
3.2 Cancellation and right of withdrawal
- Customers have the right to cancel the agreement within 14 days after concluding a subscription without giving reasons, unless a magazine has already been sent.
- Cancellation can be communicated in writing via contact details or Krijtmolen 53, 8044TK Zwolle.
- If cancellation takes place after the first magazine has been sent, no refund will be given for issues already delivered.
3.3 Cancelled shipments
- If a magazine cannot be delivered due to circumstances beyond Yvonta's control, such as force majeure or distribution problems, the customer will be informed of this as soon as possible.
- Yvonta reserves the right to postpone delivery in such cases or replace it with a digital version of the magazine, if available.
Payment and direct debit
4.1 Payment terms
- Payment is made prior to the subscription period via our payment provider Mollie.
- The subscription will only start after receipt of full payment.
4.2 Direct debit
- When taking out a subscription, the customer authorizes Yvonta to automatically debit the subscription costs from the account specified by the customer.
- If a direct debit is reversed or fails, the customer will receive a payment reminder. If payment is not made within 14 days of the reminder, Yvonta reserves the right to terminate the subscription.
4.3 Refund
- Amounts already paid will not be refunded, unless there is a legal obligation.
Resubscribing
5.1 Customers can resubscribe at any time. In the event of resubscription, the current prices and conditions apply. 5.2 Re-subscription is possible via the website or by contacting customer service via contact details.
Complaints and disputes
6.1 Complaints handling
- Complaints about the delivery of magazines or the execution of the agreement can be submitted in writing via contact details or Krijtmolen 53, 8044TK Zwolle.
- Complaints will be processed within 5 working days of receipt. If processing takes longer, the customer will receive a confirmation with an indication of the expected term.
6.2 Dispute resolution
- If a complaint is not handled satisfactorily, the customer can turn to an independent dispute committee or the European platform for online dispute resolution (ODR platform).
- All agreements are exclusively subject to Dutch law. Disputes will be submitted to the competent court in Zwolle.
7. Liability
7.1 Limitation of liability
Yvonta is only liable for direct damage die resulting from intent or gross negligence.
Yvonta's total liability is limited to the amount paid by the customer in the twelve months preceding the incident.
7.2 Force Majeure
- Yvonta is not liable for shortcomings in the performance of the agreement as a result of force majeure, including disruptions at postal companies, natural disasters or other unforeseen circumstances.
8. Intellectual property
8.1 All intellectual property rights relating to the magazines, website and other publications are vested in Yvonta. 8.2 It is not permitted to copy, distribute or commercially exploit content without written permission from Yvonta.
9. Changes to the general terms and conditions
9.1 Yvonta reserves the right to unilaterally change these general terms and conditions. 9.2 Changes will be communicated at least 30 days in advance by e-mail or publication on the website. 9.3 If the customer does not agree with the changes, the customer can terminate the agreement before the effective date of the new conditions.
